01. Introduction

Brasil Bitcoin Serviços Digitais Ltda., a company registered with the Brazilian Corporate Taxpayer Registry (CNPJ) under no. 29.519.837/0001-23 ("Brasil Bitcoin"), is an electronic platform developed for the purpose of intermediating the purchase and sale of cryptocurrencies, such as Bitcoin, Bitcoin Cash, Ethereum and Litecoin.

Brasil Bitcoin, through its website and mobile application, will collect personal data and information, with the primary aim of identifying its users and providing a safe experience, always protecting the information provided and respecting your privacy.

Brasil Bitcoin recognizes that your privacy is very important. Therefore, we take all possible measures to protect it. In this sense, this privacy policy ("Policy") aims to inform how your information and data will be collected, used, shared and stored through our systems and our application. This document must be read and interpreted together with our terms of use.

Acceptance of our Policy will occur when you register on our platform to use the website www.brasilbitcoin.com.br. This will indicate that you are aware of and fully agree with the way we will use your information and your data.

If you do not agree with this Policy, please do not continue with your registration procedure and do not use our services.

02. Information We Collect

1. Registration data: when you want to start using the Brasil Bitcoin website, you will need to register to create your account with us. To register, you will need to provide us with your CPF, date of birth and email. If you represent a legal entity, you must provide us with the legal entity’s CNPJ, its incorporation date and a contact email. With this data, you will be able to carry out transactions up to the limit defined in our terms of use.

2. If you wish to carry out transactions above the basic limits defined in our terms of use, you must also send us photos of your National Driver’s License (CNH) or Identity Card (RG), together with a photo of a proof of address and a selfie holding a handwritten note saying “Brasil Bitcoin” with the date and a signature matching the document.

3. In addition, if you wish to purchase cryptocurrencies via a credit card, you must provide your card details. If you wish to sell your cryptocurrencies, you must provide your bank details so that we can deposit into your account the amounts received from such transactions.

4. Data check for registration: Brasil Bitcoin reserves the right to verify the accuracy and other aspects related to your registration information, and may deny your registration, at its sole and exclusive discretion, based on the information collected. This check may be carried out by other companies, specifically contracted for these purposes. For this, your CPF or CNPJ number may be shared with such companies. Among other information, we reserve the right to verify, with public authorities such as state courts and federal courts, your involvement in legal proceedings of any nature, your status with credit protection institutions, national and international lists such as those issued by Interpol and the Specially Designated Nationals and Blocked Persons List or similar lists, as well as other publicly accessible information about you.

5. In addition, for greater security, you will be asked to perform a two-factor authentication process using token (security key) delivery tools via SMS or phone call for phone confirmation.

6. Payment data: Brasil Bitcoin allows you to buy and sell cryptocurrencies. For this purpose, data related to the transactions you carry out will be collected. Whenever a transaction occurs, our system will store the date, the amount and the users who participated in the transaction.

7. Automatically collected data: Brasil Bitcoin collects some data automatically, including characteristics of your device, such as your operating system and language, as well as application access logs, which include the IP address, with the date and time of access to Brasil Bitcoin. Some of this data is mandatory to collect, in accordance with Law 12,965/2014, but it will only be provided to third parties with your express authorization or by court order. As mentioned above, to facilitate your identification, Brasil Bitcoin uses a security key, which will serve to authenticate you and keep your settings saved. This security key will be stored in a cookie, which will allow Brasil Bitcoin, for your security, to control the duration of your session.

03. Use of Data

1. All data collected will be deleted from our servers when you so request or when it is no longer necessary or relevant for us to provide our services to you, unless there is any other reason for its retention, such as a possible legal obligation to retain data or the need to preserve it to safeguard Brasil Bitcoin’s rights.

2. Brasil Bitcoin reserves the right to monitor the entire platform, including the frequency and parts of the transactions in which you take part, the number of active sessions, systems and devices that access the platform, among others, mainly to ensure that Brasil Bitcoin is not used for illegitimate purposes and to ensure that the rules described in our terms of use are being observed. Therefore, Brasil Bitcoin reserves the right to block the account of a given user, at its sole and exclusive discretion, if such monitoring indicates that the platform may be being used for such purposes, with it being possible to prove the legitimacy of the transaction if the user proves it by resending the information provided in item 1 above. Brasil Bitcoin also reserves the right to delete a given user, regardless of the type, if this Policy is not complied with.

04. Data Sharing

1. Brasil Bitcoin reserves the right to share your information with business partners for the sole purpose of verifying its accuracy and your legal status, as mentioned in item 1 above. By means of this document, you expressly authorize such sharing.

2. All data, information and content about you may be considered assets in the event of negotiations in which Brasil Bitcoin is involved. Therefore, we reserve the right to include your data among the company’s assets if it is sold, acquired or merged with another. Through this Policy you agree to and are aware of this possibility.

3. Furthermore, Brasil Bitcoin reserves the right to provide your data and personal information, including your interactions, if judicially required to do so, an act necessary for the company to comply with national laws.

05. Data Security

1. All your data is confidential and only people with the proper authorizations will have access to it. Your name, CPF or CNPJ, date of birth or incorporation date and email may be accessed by Brasil Bitcoin’s customer service department to enable such service.

2. Any use of your data will be in accordance with this Policy. Brasil Bitcoin will make every effort to ensure the security of our systems and your data. Our servers are located in different locations to ensure stability and security, and can only be accessed through previously authorized communication channels.

3. All your data will always be stored in encrypted form. At any time you may request a copy of your data stored in our systems; just contact us and make a request. We will keep the data and information only for as long as they are necessary or relevant for the purposes described in this Policy, or in the case of periods pre-determined by law, or for as long as they are necessary for the maintenance of Brasil Bitcoin’s legitimate interests.

4. Brasil Bitcoin uses modern security measures in order to ensure the protection of your personal data against any unauthorized access. We use 256-bit SSL (Secure Socket Layer) technology, which encrypts and protects the data transmitted on our servers.

5. Only authorized employees of Brasil Bitcoin may have access to your personal information, being mandatorily subject to confidentiality duties and strict respect for your privacy.

6. We will do what is within our reach to protect your information; however, we cannot completely guarantee that all data and information about you on our platform will be free from unauthorized access, especially in the event of improper sharing of the credentials necessary to access our applications. Therefore, you are solely responsible for keeping your access password in a safe place, and sharing it with third parties is prohibited. You agree to notify Brasil Bitcoin immediately, through a secure means, of any unauthorized use of your account, as well as unauthorized access to it by third parties.

06. Privacy Policy Updates

1. Brasil Bitcoin reserves the right to change this Policy as many times as necessary, aiming to provide its customers with increasing security and convenience. That is why it is very important to access our Policy periodically. To make it easier, we will always indicate at the beginning of the document the date of the last update. If relevant changes are made that require new authorizations from our customers, we will send a notification to each of our users.

07. Applicable Law

1. The courts of the district of São Paulo, state of São Paulo, are elected as the sole competent venue to settle any disputes arising from this document, regardless of any other, however privileged it may be or may become.
